As part of our practice we collect, use, and disclose personal information pertaining to clients and other individuals regularly. Rest assured, we take great care in handling any personal information you share with us in compliance with all applicable laws and regulations. Our professionals, employees, and agents are also bound by ethical and professional obligations to maintain confidentiality. This Privacy Policy outlines how SNR collects, uses, and discloses personal information in order to help you understand our policies and procedures.

By choosing to provide personal information to SNR, by any method, including through our website, email, in person, or by phone, you consent to its collection, use, and disclosure in accordance with this Policy. Personal Information

Personal Information is defined under Quebec’s Act Respecting the Protection of Personal Information in the Private Sector (“QPA”) as: “any information which relates to a natural person and allows directly or indirectly that person to be identified”.

In order to provide you with practical legal and tax advice, SNR may request personal information regarding you and/or other persons involved in the matter at hand, which may include family members, directors, officers, shareholders, employees, business partners, etc. Please note that if you provide us with personal information about other individuals, we will assume that you have obtained the required consent or authority in order for us to collect, use and disclose such information in accordance with this Policy and that you have provided such individuals with appropriate notice of the disclosure. This allows us to collect, use, and disclose the information for the purposes outlined in this Policy, or as permitted by applicable law.

The type of personal information that SNR may need to collect, may include your:

  • Legal name and/or known name.
  • Contact information such as your residential address, email addresses, and telephone numbers;
  • Occupation and related documentation including the name of your employer
  • Identification documentation and other background verification information including your date of birth such as driver's license or passport.
  • Billing and account information which may include financial and credit information;
  • Tax residency; and
  • Any other pertinent information which may be required in order for us to provide the requested services.

 

Personal information is also collected from you when you provide personal information to us through various methods of communication, such as by telephone or by email or by signing up for our newsletter. When you visit the firm’s website certain information may automatically be obtained and collected (in our log file) including your internet protocol (IP) address and associated information which can identify you as an individual. We may also collect geolocation information and use certain technologies including (i) cookies, which are small pieces of data that are used to identify your computer and are saved when you visit a website such as usernames or passwords; and (ii) web beacons and pixels, which are methods used to track web page visitors or who has opened an e-mail.

Except for extreme scenarios involving the legal representation, safety, and protection of a minor, we do not knowingly collect information from children under 14 years old without the express consent of a parent or guardian. Consent, Use And Purpose

At the time of the collection of personal information from you, SNR will clearly indicate the purpose for its use and collection and shall only disclose personal information in relation to its intended purposes, or as permitted or required by law.

In addition to collecting, using and disclosing personal information for the provision of our legal services, we may collect use and disclose personal information in order to fulfill our professional obligations in identifying and verifying clients, to evaluate potential clients, to meet our contractual, legal and regulatory obligations and to manage our current client relationships including the administration of the client accounts (invoicing, processing payments, assessing creditworthiness, and fulfilling contractual obligations). SNR may also use your personal information for any other purpose for which we have obtained your consent.

As your confidence in us is essential to our firm, have no doubt that we do not use or disclose your personal information for purposes other than those for which it was collected, unless we have obtained your consent or are permitted or required to do so by law. In the cases required by law pertaining to sensitive personal information we will ensure we obtain your express consent. Nonetheless, SNR may collect, use, or disclose your personal information without consent in certain circumstances, as permitted or required by law.

Consent Required For Other Purposes

SNR may also request to use your personal information for the distribution of SNR newsletters, invitations to events, and to contact and communicate with you for the purpose of evaluating your satisfaction with our client service. If you provide SNR with your email address, SNR may periodically send you emails containing information about SNR and other topics it believes will be of interest to you. Disclosure Of Personal Information

In providing practical legal and tax advice tailored to your specific needs, as we are bound by professional and ethical obligations and more importantly as our client relationships are the foundation of our firm, we will not disclose personal information that is protected by attorney-client privilege unless you have waived such privilege, or it is required or permitted by law.

As indicated above, we may disclose personal information as required or permitted by law or if we believe in good faith that such disclosure is necessary to comply with applicable laws. We may provide personal information to law enforcement or any other government or regulatory entity that has the lawful authority to obtain the information, including but not limited to, in response to a court order, subpoena or warrant.

In certain cases, pertaining to business transaction or legal proceedings, SNR may disclose personal information to third parties in adherence with our professional obligations, which may include service providers, adverse parties and their counsel, experts, and witnesses. SNR may also share personal information with third-party service providers who as a part of providing website development, hosting, maintenance, and other related services to us may process or have access to personal information. We ensure that our contracts with such third parties include protective measures as required by law to safeguard such personal information and to limit its use to what is reasonably necessary for the mandate given.

No personal information held by us shall be sold or exchanged for consideration, however, should SNR merge or otherwise reorganize, we disclose your personal information to the resulting organization.

Storing And Securing Personal Information

Considering the sensitivity of the information, SNR takes appropriate security measures to protect the confidentiality of your personal information utilizing security measures that are customary in the legal industry and that are appropriate for the sensitivity of the information including appropriate physical, technological, organizational and administrative measures and safeguards to prevent accidental or illegal destruction, loss, unauthorized alteration, disclosure, access, or misuse of personal information in our possession. We have provided and will continue to provide personnel training including clear internal policies and practices and will ensure that safeguards that help protect your personal information such as limiting access to offices, restriction access to information and implementing passwords remain a priority.

Your personal information may be stored and processed by SNR at our offices in Montreal, Quebec, Canada. SNR may store your personal information in other locations and engage third-party service providers to store, handle, or process personal information on our behalf. We only engage reputable third party service providers who are contractually obligated to protect your personal information from unauthorized access, collection, use, or disclosure, and they are not allowed to disclose your information to others.

Despite our best efforts, no method of communication over the Internet or electronic storage is completely secure due to the inherent risks associated with the internet. We cannot guarantee that personal information will not be accessed, disclosed, altered, or destroyed due to the breach of any of our physical, technical, or administrative safeguards. In case of a breach of our security safeguards resulting in a real risk of significant harm to you, we will notify you, unless prohibited by law. Retention Of Personal Information

SNR will only retain personal information as required to fulfill our professional obligations and in accordance with applicable law and regulations. We will only hold on to such information in order to complete the related purposes specified to you as a client pursuant to this Privacy Policy. Access To Personal Information

If you provide us with a written request, SNR will, subject to certain exceptions, inform you about the existence, use, and disclosure of your Personal Information and provide you with access to that information.

As a client, you have reasonable access to your personal information and may help us maintain its accuracy by informing us of any changes or updates. You may also challenge the accuracy and completeness of the personal information we have on record with the exclusion of specific cases stipulated by law. Accordingly, SNR will amend your personal information in case of incompleteness or any proven inaccuracies. Nonetheless, some exceptions apply, such as personal information that contains references to other individuals, is protected under attorney-client privilege, information that is legally restricted, security-sensitive or commercially proprietary.
